Terms and Conditions. Clinical Services. 1.      Your   Care   is   provided   and   facilitated   by   Dr   I.   Fraser   Duncan   and   Executive   Clinical   Services   Ltd   (I)   /(we)/   (us).   Acceptance   of   these   Terms and Conditions of Care is implied by the patient (you)/(your) on receipt of services. 2.      Terms   and   Conditions   of   Care   applies   to   services   supplied   privately   by   us.   Care   received   under   the   care   of   the   National   Health   Service   is provided under the general Terms and Conditions supplied by that organization. 3.      Care   or   treatments   undertaken   within   a   private   hospital   facility   are   furthermore   subject   to   the   Terms   and   Conditions   applying   to   that hospital or clinic and available through their website or on request. 4.      All   medical   services   are   given   in   good   faith,   and   according   to   current   best   practice   guidelines.   However,   it   must   not   be   assumed   that   advice or   treatment   recommended   by   us   is   the   only   alternative   management   available.   Your   Care   is   provided   with   reference   to   ‘Good   Practice’ guidelines published by the General Medical Council (UK) and information is available at   5.      You   must   reply   honestly   when   asked   for   information   by   our   doctors.   We   are   not   responsible   if   you   withhold   information   or   do   not   disclose information concerning your past medical history, prescription or other medications, allergies, current therapies and other clinical input.   6.  We reserve the right to refuse to administer a treatment if a doctor or nurse deems it inappropriate.   7.      Your   treatment   may   be   linked   with   other   specialists   as   may   be   the   case   in   some   circumstance   for   further   specialist   treatment   or investigations.   We   are   not   personally   liable   for   error   or   misadventure   arising   from   this   link   or   the   third   party   nor   for   any   error   or   for   damages resulting by their omission or commission. Relevant safeguards and terms/condition of the third party should be separately observed.   8.      It   is   our   policy   and   a   General   Medical   Council   recommendation   that   a   female   chaperone   is   always   present   while   female   patients   undergo close   or   intimate   examinations   or   tests   by   male   clinicians.   This   chaperone   may   be   one   of   the   female   reception   staff   when   a   nurse   is   not available;   alternatively   you   may   bring   along   a   family   member   or   friend   yourself.   If   this   is   unacceptable   to   you,   please   indicate   your   requests when booking.   9.      Children   under   16   years   of   age   will   not   be   seen   unless   accompanied   by   a   parent   or   other   person   with   parental   responsibility.   However,   with consent of both parties, a child under 16 may be seen privately for non-intimate examinations.   10.   In   cases   of   prescription   request,   this   is   a   private   script   and   can   be   redeemed   from   any   UK   pharmacy   but   not   NHS   pharmacy.   The   cost   of medication must be met by the patient. It is necessary to have prior consultation before prescription generation at least for the initial issue.   11.   Most   blood   and   laboratory   test   results   are   available   within   1-5   days   depending   on   the   nature   of   test,   please   be   aware   that   certain   test results   can   take   longer   but   you   will   be   advised   at   the   time   of   request.   Test   will   only   be   carried   out   subject   to   appropriate   pre,   post-test counselling. Results are disclosed only to the patients.   Fees policy Prices   are   subject   to   change   without   notice.   However,   cost   of   treatment   may   be   discussed   with   the   patient   prior   to   commencement   at   your request. Insured patients: 1. You agree to pay for care, treatment, diagnosis, services (including Sundry Items) and goods provided by us (together, your “Care”). 2. Whilst you will remain responsible for the payment of your Care, where you have private medical insurance: a.   we   will,   where   possible,   process   the   insurance   claim   for   your   Care   with   your   insurer,   provided   you   have   given   us   and   your   insurer   all   the information   we   and   your   insurer   need   to   do   so.   If   this   information   is   incomplete   or   inaccurate,   we   may   not   be   able   to   process   your   claim   and we will invoice you direct; b.   where   we   process   your   insurance   claim   and   your   insurer   pays   us   direct,   fees   will   be   in   accordance   with   pubished   guidelines   from   Bupa   Uk. You will remain responsible for the balance of your account not paid by your insurer. c.   where   your   insurer   fails   to   settle   our   invoices   (or   any   part   of   them)   within   60   days   of   the   date   of   issue   we   will   assume   that   the   outstanding amount will not be paid by your insurer and we will invoice you direct; and d.   where   your   insurer   declines   to   pay   the   applied   fees   for   your   Care   we   will   invoice   you   direct.   If   you   fail   to   settle   invoices   within   30   days   of our notification additional charges may be applicable. 3.   It   is   your   responsibility   to   confirm   with   your   insurer   that   your   Care   is   covered   by   your   insurance   policy   and   we   will   not   obtain   any   such confirmation on your behalf. 4.   Please   note   that   some   insurers   use   care   guidelines   that   may   not   match   the   professional   medical   opinion   of   the   Consultants,   nursing   staff and   other   medical   professionals   providing   your   Care.   In   some   cases   this   can   mean   that   your   insurer   may   not   pay   for   certain   parts   of   the   Care you receive, and you will be required to pay for that part of your Care. 5.   Please   note   that   your   insurance   policy   may   not   cover   the   cost   of   Sundry   Items   or   other   items   such   as   specialist   equipment,   or   medicines,   or it may only cover part of such costs. You will be required to pay for any such items not reimbursed by your insurers. 6.   If   you   pay   for   your   treatment   and   subsequently   seek   reimbursement   from   your   insurer,   and   if   no   other   rate   has   been   expressly   agreed,   the standard Bupa rates will apply to your Care. 7. If no rate has been agreed between us and your insurer in respect of your Care, the Bupa Standard Rates will apply to your Care. 8.   Where   we   invoice   you   for   your   Care   or   an   element   of   it   you   agree   to   pay   us   the   amount   invoiced   within   30   days   without   deduction   or   set- off. Self pay patients: 1. You   are   responsible   for   payment   for   your   Care   and   you   agree   to   pay   for   care,   treatment,   diagnosis,   services   (including   Sundry   Items)   and goods provided by us (together, your “Care”). 2.  The fees for your care will be in accordance with the Bupa Standard fee guidelines. 3.  Invoices for your Care will be submitted without unreasonable delay and you agree to pay us within 30 days of invoice date. Unpaid/late payment fees policy : 1.      Where   fees   remain   unpaid   after   30   days   (or   60   days   if   you   have   medical   insurance   and   invoices   are   sent   directly   to   your   insurer)   we reserve the right to charge a late payment fee of £50 or 10% of your invoice total per week whichever is the greater. 2.      Where   fees   remain   unpaid   after   90   days   a   further   invoice   notice   will   be   sent   to   your   last   recorded   address   followed   within   28   days   by   a prelegal   notification.   Payment   of   outstanding   fees   is   required   in   full   and   including   any   applied   late   payment   charges   without   deduction   or   set- off and within 14 days of the invoice date. 3.         If   payments   remain   outstanding   your   invoiced   amount   as   in   (2)   above   will   be   transferred   to   a   debt   collection   agency,   Daniels   Silverman Ltd,   with   the   addition   of   professional   fees   and   costs   applicable   at   the   time.   Their   Terms   and   Conditions   apply   and   may   be   found   at www.danielsslilverman.co.uk.   When   your   debt   is   transferred   payment   will   be   made   through   Daniels   Silverman   Ltd   and   their   costs   will   be reclaimable in addition to any invoiced amounts and late payment charges. Cancellation policy: 1.         We   recognize   that   it   is   not   always   possible   for   you   to   attend   your   booked   appointment   with   us.   However   we   reserve   the   right   to   charge   a late   cancellation   fee   for   all   clinic   or   consultation   booking   which   are   not   attended   or   for   which   cancellation   notification   is   not   received   within   24 hours. In exceptional circumstances the late cancellation fee will be waived at your request.   12.      Dr   I.Fraser   Duncan   has   a   zero-tolerance   policy   with   respect   to   the   verbal   or   physical   abuse   of   our   staff,   or   damage   to   our   property. Offenders (together with appropriate supporting evidence) will be referred to the police for prosecution. Privacy policy: Dr I. Fraser Duncan takes the privacy of all patients and web site users very seriously and takes great care with customer and user information. This Privacy Policy Statement outlines how your personal information will be treated. Our security and privacy policies are periodically reviewed and enhanced and you should check this page regularly to see our most up to date policy. Any   information   you   disclose   to   us   will   be   treated   as   confidential.   We   will   not   disclose   any   personally   identifiable   information   to   any   third   party except   (where   applicable)   to   your   NHS   GP   without   your   express   permission.   If   you   do   not   wish   your   NHS   GP   to   be   informed,   please   make   this clear at registration although we recommend that your GP be closely involved in your Care. We   do   not   sell   user   information   to   any   other   organisation.   User   information   is   used   only   to   improve   our   services   or   to   notify   users   of   new services and in aggregate (and therefore anonymously) to track activity on our web site In   order   to   provide   you   with   our   services,   we   may   collect   personal   information   about   you   from   our   web   site,   telephone   conversations,   emails and   written   communications.   We   may,   for   example,   keep   a   record   of   your   name,   address,   email   address,   and   telephone   number   for   further communication with you or third party as appropriate. If   your   personal   details   needs   to   be   passed   on   to   third   party   as   may   be   the   case   in   certain   circumstances   such   as   referral   to   other   specialist, your   express   consent   will   be   sought.   Please   let   us   know   if   any   of   your   personal   information   changes   or   is   inaccurate   so   that   we   may   keep   our records up to date. Complaints process 1.  Complaints procedure will be followed in accordance with ‘Good Practice’ guidelines (vs). 2.      On   receipt   of   notification   of   a   complaint   or   query   a   letter   of   acknowledgement   will   be   returned   by   us   to   you   usually   within   7   days   of   receipt of correspondence, holidays and other absences permitting. 3.      The   details   of   your   concerns   will   then   be   investigated   and   addresses   and   a   further   letter   will   be   sent   within   21   days   in   response   to   your complaints. 4.      It   may   be   necessary   to   send   further   correspondence   if   third   parties   need   to   be   consulted   about   your   concerns,   and   additional   letters   of clarification or response will be sent within 28 days if necessary.
